The Southern Region II Association for Intercollegiate Athletics for Women is
composed of member state organizations from Kentucky, North Carolina , South
Carolina, Tennessee and Virginia. The purpose of this regional association is
to foster broad programs of women's intercollegiate athletics consistent with
the education aims and objectives of members, and in accordance with the philosophy and standards of the N.A .G.W. S. and AIAW.
STRUCTURE

The regional Executive Board shall consist of:
1.

The AIAW Southern Region II Representative, chairperson

2.

The past Southern AIAW Region II Representative, Treasurer

3.

The state presidents of each of the five states of Southern Region II .
In the event the president 's college is a non-member of AIAW, the state
organization shall appoint a representative from a member college . A
secretary will be appointed on a rotational basis from these members.

4.

The Chairperson of the Southern Region II Ethics and Eligibility Committee.
Each of the above officers is entitled to one vote.
FUNCTION

The function of the Southern Region II Executive Board shall be:
1.

To maintain open channels of conununication among national, regional and
state organizations concerned with intercollegiate athletic competition
for women.

2.

To represent state concerns
Executive Board.

3.

To serve as an advisory group to the regional representative in such matters
as: securing nominations; reviewing championships bids; recommending
championships sites; establishing policies and procedures for regional
events.

4.

To sponsor regional qualifying events as requested by AIAW.

5.

To review the function of regional structure and make reconunendations for
future development.

6.

To assist the regional representative in appointing special committees .

The membership of Southern Region II shall consist of AIAW member institutions from
the five states: Kentucky, N. c., S . c., Tennessee and Virqinia. The fee for
membership per year is $10 .00 per insti tution for Active membership, and $5.00 for
Associate payable by October 15 to the Southern Region II tre asurer. The membership app lication should accompany the check .
MEETINGS

1.

The Executive Board meeting shall be annually in the spring of t he ye a r. The
Regional Representative may cal l additional meetings when deemed necessary.

2.

A general meeting of a ll Southern Region II AIAW Act ive member schools shall
be conducted at an appropriate time during each year . Associate members and
interested persons may attend without a vote.
CHAMPIONSHIPS COMMITTEES

There shall be a championships committee for each sport in which a regional
championship is conducted. Each committee shall be appointed by the championship
director , who shall serve as Chairperson. Each committee shall be responsible for
conducting the championship in accordance with AIAW and Southern Region I I poli cies
and procedures. The chairperson of the conunittee shall submit a complete written
report of the championship to the regional representative.
ELIGIBILITY FOR TOURNAMENTS

1.

Regional championship participants must be Active members of AIAW and Southern
Region II and respective state associations.

2.

In all regional tournaments and championships, the Executive Board shall determine the number of entries from each state .

3.

The representative(s) from each state shall be determined by the state organization.

The Southern Region II endorses through its operating Code the philosophy and operational standards established by AIAW and NAGWS .

The rotation system of tournament sites as followed in previous years has been
eliminated. All states in Southern Region II may bid for ari.y cf championships
offered in our regiona The site selec-:tion committee will make a concerted effort
to vary the location sites within the region whenever possible. All institutions
are encouraget1 to subw.it bids as early as poss.i_ble . Bids are now open for 197576 for Large College Basketball and Tenniso

AIAW National Ch~icnships (Action taken AIAW Executive Board, Chicago# I L.
May 20-22 , 1975)

AIAW will offer large, small, a..~d junior c-ollege cha.mpionships in the· following
sports: basketball and volleyball. Regions will thus offer qualifying tournaments
by which large, small, and ju.t'lior. colleges can ad11ance to the Nationals .
It is

left up to the individual state as to how their tealI'S qualify for the region
championship. Small college is defined as: an institudon with 3000 or less ,
full- time, female, undergraduate students.
6.

Eligibility for s,ouJ:,11.eZ!!, Region II Championshi~

In order to partid.pate in any Southern Region II qualifying events, an .institution must be an •Active membe:s:- of AIAW, Southern Region II, and their re-·
spective state association or federatior
7.

Officials Re~ion II_Championships

Each_ state in Region II will be responsible for securing officials for both
Volleyball and Basketball for both the l arge and small college tournaments. Eac.~
state is responsible for travel expenses of t.~e officials b;at will represent their
state. Guidelines were developed for championships officials .
9.

Officials coordinator

If a state does not have an ABO state officiating coordinator, each state
president will appoint a state coordinator of offici.als who will be responsibl e
for securing officials from their state for the southeni Region II Volleyball and

The Southern Region II Asso ciation for Intercollegiate Athletics for Women is
composed of member state organizations from Kentucky, North Carolina, South
Carolina, Tennessee and Virginia. The purpose of this regional association is
to foster broad programs of women ' s intercollegiate athletics consistent with
the education aims and objectives of members, and in accordance with the philosophy and standards of the N.A.G.W.S. and AIAW .
STRUCTURE

The regional Executive Board shall consist of:
1.

The AIAW Southern Region II Representative, chairperson

2.

The past Southern AIAW Region II Representative, Treasurer

3.

The state presidents of each of the five states of Southern Region II.
In the event the president ' s college is a non- member of AIAW, the state
organization shal l appoint a representative from a member college . A
secretary will be appointed on a rotational basis from these members.

4.

The Chairperson of the Southern Region II Ethics and Eligibility Committee.
Each of the above officers is entitled to one vote.
FUNCTION

The function of the Southern Regi on II Executive Board shall be:
1.

To maintain open channels of communication among national, regional and
state organizations concerned with intercollegiate athletic competition
for women.

2.

To represent state concerns to the regional representative and the AIAW
Executive Board.

3.

To serve as an advisory group to the regional representative in such matters
as: securing nominations; reviewing championships bids; recommending
championships sites; establishing policies and procedures for regional
events.

4.

To sponsor regional qualifying events as requested by AIAW .

5.

To review the function of regional structure and make recommendations for
future development .

6.

To assist the regional representative in appointing special committees.

The membership of Southern Region II shall consist of AIAW member institutions from
the five states: Kentucky, N. C., S . C., Te~nPssee and Virqinia. The fee for
membership per year is $10.00 per institution fo r Active membership, and $5.00 for
Associate payable by October 15 to the Southern Region II treasurer . The membership application s hould accompany the check.
MEETI NGS

1.

The Executive Board meeting shall be annually in the spring of the year. The
Regional Representative may cal l additional meetings when deemed necessary.

2.

A general meeting of all Southern Region II AIAW Active member schools shall
be conducte d at an appropriate time during e ach year . Associate members and
interested persons may attend without a vote.
CHAMPIONSHI PS COMMITTEES

There shall be a championships committee for each sport in which a regional
championship is conducted. Each committee shall be appointed by the championship
director, who shall serve as Chairperson . Each committee shall be responsible for
conducting the championship in accordance with AIAW and Southern Region II policies
and procedures . The chairperson of the committee shall submit a complete written
report of the championship to the regional representative .
ELIGIBILITY FOR TOURNAMENTS

1.

Regional championship participants must be Active members of AIAW and Southern
Region II and respective state associations.

2.

In all regional tournaments and championships, the Executive Board shall determine the number of entries from e ach state .

3.

The representative(s) from each state shall be determined by the state organi zation .

The Southern Region II endorses through its operating Code the philosophy and operational standards established by AIAW and NAGWS.

leadership during your tenure as AIAW President-Elect and President~ AIAW
is fortunate to have s uch dynamic leadership particularly during these fonnative
years when policy and procedures·are being established. Region II is doubly
proud to be so represented. We appreciate your role and the many decisio·n s you
were and are called on to make in our behalf.
Executive Board wants to go on record in support of -your stating the position
for us in the recent NCAA proposal. The letter was timely, factual and most

Basketball championships will be conducted for large co llege s, small colleges
and junior colleges in Southern Region II.
SITES AND DATES:

The large and small college basketball championship will be conducted
March 11 - 13, 1976. Junior college championships wi l l be conducted that
same weekend. The length of the tournament will be de t e rmined by the number
of entries. The sites and directors are as f ol l ows :

Junior Colleges

1.

Southern Region II will pay for awards. A logo has b een adopted and
awards have been ordered accordingly by Jan Watson.

2.

The hostess institution will charge gate receipts. Gate receipts will
help to defray expenses and any profits realized wil l be divided equally
between Southern Region II and the hostess instit ution. The followi.ng
are recommended:
Gymnastics, Volleyball, Field Hockey, Tennis, Basketball

3.

Adults - $2.00 per day

$3.50 - 2 day pkg .

$5.00 - 3 day pkg.

Students - $1. 25 per day

$2.00 - 2 day pkg .

$3.00 - 3 day pkg.

In order to participate in any Southern Region II qualifying event, a
school must be an Active member of AIAW, of Southern Region II and of
the respective state association.

GUIDELINES
1.

N.A.G.W.S. National Officials are pre f erred; however, State officials
will be accepted when necessary. The f ive states within Southern
Region II will continue to recommend officials. Each state, excluding
the hostess states in large and small college tournaments, will send
2 officials to each tournament. Hostess states will send 2 officials
only to the large or small tournament being held in their states . For
each tournament a committee for securing offici a l s will be made up
with one member from each state. It is advised that this be the State
Officiating Coordinator . The hostess state 's repre sentative shall
serve as chairperson. Basketball fees for officials will be $25 for

BASKETBALL CHAMPIONSHIPS

National and $20 for State officials. Each state association will
assume transportation costs (meals and lodging where applicable)
of its officials to the tournament sites. The tournament director
will assume responsibility for lodging arrangements and costs for
officials. Each official will be reimbursed for food expenses up to
$10 per diem maximum while officiating at the tournament. An officials
committee and chairperson will be appointed by Southern Region II Executive Board and the championship director prior to championships.
This committee wil l consist of at least 3 persons and will be in
'charge of assigning officials.
2.

Teams will be limited to seventeen (17) persons within the. entry fee.
These 17 persons (players, coaches, trainers, managers , statisticians,
etc.) will be included in the initial fee. An additional $2.00 will
be charged for each extra person affiliated with the team .

3.

The entry fee for basketball will be $100 . 00. This includes all costs,
no additional monies will be assessed for officials or such.

4.

A plaque will be presented to first , second, 3rd, 4th and conso l ation
winners in each basketball tournament.

S.

Eight teams will participate in each (large and small) championship.
In each tournament each state may send l representative. The top four .
finishers in 1975 were seeded for the 1976 tournaments. Tennessee was
seeded first place in each 1976 regional championship (first in large
college, first in small college); a draw determined the placements of
semi-finalists, N~C. and S.C., in the large and small college champion- ·
ships for 1976. The hostess school will make up the 8th team. No more
than 2 teams from any state shall participate in any regional tournament unless a team is the hostess state .

6.

The hostess school has the option of entering the regional championships .. If that school finishes first in its respective state tournament another qualifying team from that state takes its hostess spot.
It is the responsibility of each state to determine its regional representatives. The hostess school MUST compete in its respective
state tournament in order to be eligible to participate in the regional.

7.

The basketball championships will be three day single elimination consolation tournaments beginning Thursday afternoon. Each team will
play one game the first 2 days. The final day the championship game,
the final consolation game and the game to determine third and fourth
places will be held . The time schedule and brackets for each tournament are attached.

A Basketball Championship Appeals Committee will be appointed by the
Ethics and Eligibility Conunittee.

The championship director will file a complete report with the Regional
Representative within three weeks after the event.

each pool will enter a double elimination playoff to determine reg i onal winners. The pools and bracket for each tournament for 1975
i s on the attached sheet . The tie breaking method for pool p lay will

If a singl e team in a pool wins all of its games, the fi rst
and second place teams will be clearly estab l ished.
If two teams in a pool establish a 2 win - 1 loss record, the
f i rst place team will be the winne r of the match played between the two teams . The loser of that match will be the
second place team from the pool.

If three teams establish a 2 win - 1 loss record, the fo llowing
procedure will be followed:
1)

Total points scored against each t eam by the other
two teams involved in the tie will be determined.

2)

The team with the f ewest total points scored agains t it
will be the first place team from the pool.

The Southeastern Region 3 Basketball Committee is trying to
secure information from all regions on currerit policies that exist
regarding their regional basketball prog~am . Region 3 has made a
gallant effort to establish a region b.asketbal l committee which
in reality will be a governing body for our basketball. We have
met several times and we are extremely interested in other region's
policies regarding their qualifying tournaments f or the nationals,
policies on officiating, financ ial matters (iplit of gate) and
many more.
If you could place me in contact with your regional chairman
or send me a copy of your current policies it would help our
region committee tremendously.
If we can be of any assistance please contact me . Your
immediate attention to this matter will be greatly appreciated.

Raleigh, N., C., and s he w11.l direct the J . c. basketball tourney and it will be at western Ca rolina a t
Cullowhee, N. c. Please send the bid form to Nora Lynn
at Peace. The other J. c. tournaments will be with the
:regula r ones :for t h i s year. There a.r e only two sehools
doing tennis and two doing volleyball in Region II .

to contact the board and even then I never got west ..

for Virginie and the secretary tried to· reach you,

On behalf of Region II, I want to thank you for the

department's will.ir1..gness to host the volleyball

tournaments at Memphis State this past week. I know
Jane was director, but I also know any undertaking of
this size must be a departmental effort . I t seemed
to be most organized and well run from the impressive
openi ng ceremonies to the presentation of awards. ( I
still want to hire that great cheering section from
the lab school).

Region II is fortuna te to have Memphis State in its
region and we certainly depend on you and your staff.
Thank you again for all the worlt and effort and so
little glory attached to hosting one of the tournaments.

I personally thoroughly enjoyed my visit to Memphis and
appreciate all of your e.fforts in behalf of Winthrop and

me .

How can I properly thank you fo:r Region II? for Winthrop?
and for me? The tournaments were both most successful
and Region II extends a hearty "thank you 11 fo:r undertaking
two tournaments on nne site . What an act to follow?!
Everything seemed tc go quite s m.oothly anc seemed most
organized. I am sure Joe and the family we.re glad to get
you ba.ck! !
Winthrop sincerely appreciates all you did ror them. The
:ferring service vras a tremendous undertaking and we had
not counted on such hospitality ~· even in Tennessee.
Come this way and we shall try to repay some of it, but
there ·• s no way to tGll you how much the many
m:eant and how much easier Linda 1 s job was because of
same .

Enjoyed the socializing - am anxious "to get printout
from the hockey t ea.u sign-up sheet. So glad you all could
wo:rk in the basket~bo.11 game bet~ee;.-i PRK and Delta State .
Please thank all of the talks involved - the hospitality
room committee, transportation, opening ceremonies, registration and on and on. It was a fine event and Region II
is indebted and you should. be Justifiably proud!

Intercollegiate Athletics for Women

We will need another scholarship form for the. tennis girl. I understand
that she will have to be filed a second time if the sport has a split
season.
Also, maybe you can help .me with another matter. The University of
North Carolina at Chapel Hill has never received it's copy of the AIAW
Handbook. We have called the Washington Office and never are given an
opportunity to speak to Ms. Hutchcraft. We have asked her to return our
calls but no success. What can we do, that we haven't, to get one copy
of the AIAW Handbook? Is there an agenda for the 1976 Delegate~
Assembly? We haven't received any information.

Review of and Comments on "A Legal Opinion" Regarding
NCAA's Obligations to Women Athletes,Dated November 21,
1975

The NCAA legal opinion, dated November 21, 1975, is based upon the
following theories, each and every one of which AIAW's legal
counsel dispute:
1
That the NCAA is required to apply its policies to
women and initiate a women's program because its own
constitution and by - laws do not limit application to men;
2.
That the 14th Amendment to the U.S. Constitution
requires that NCAA initiate a women's program;
3.
That equal opportunity for women can only be pro vided through NCAA;
4.

participating in such programs, it must be concluded that NCAA
rules govern all athletic activities, under whatever auspices,
and all participants therein, at all institutions which belong to
NCAA.
At the outset it should be noted that the NCAA voluntarily and unilaterally changed the wording of its own constitution and by-laws
to s.ubstitute the term "student athlete" for "male student athlete "
Such change was not made under any governmental or judicial directive . Nothing prevents the NCAA from again amending its own constitution and by-laws to make clear that its rules apply to student
athletes not on the basis of their sex but rather on the basis of
their participation in NCAA or NCAA sanctioned programs or events l/
The assumption that the NCAA's rules apply to all activities and
athletes at all member institutions simply because the NCAA constitution does not specify otherwise is even more absurd, in logic and
in law . No matter how broadly a law or a rule is drafted, common
sense ~nd the rules of statutory construction presuppose that it
must be construed in light of the subject matter to which it logically relates. The NCAA's rules logically relate to NCAA programs
and events, and have no more to do with other athletic programs
and events than they do with a member institution's English department
Thus, it follows that if an institution subjects itself
through membership to the governance of two intercollegiate athletic organizations, one for its women's program and another for its
men's program, the rules of each would apply to the students, male
or female, participating in the program sponsored or sanctioned by
that · organization. While membership in an intercollegiate governing organization is institutional, program participation is through
individual students and coaches.
It is no more reasonable for NCAA
to claim its rules and regulations apply to persons and programs
unrelated to its program offerings than it would be for AIAW to
seek to enforce its rules and regulations against the entire athletic program of an institution although it offers no program and
provides no service relating to men's athletics.
In reality, the NCAA's contention that its rules and regulations
apply to ~1i students at a member institution amounts to a declaration tha·t there is no room for any intercollegiate athletic governing organization : except the NCAA or, in the alternative, that any
other intercollegiate athletic governing organization must be
subservient to the NCAA.
It is our opinion that no existing law,
public or private , requires or supports the NCAA's assertion that

its rules and regulations apply to all students at a member institution. AIAW members who also hold membership in other intercollegiate athletic governing bodies, such as NCAA and NAIA, must con form to those organizational rules and regulations on the basis of
the particular program under which each individual team or squad
participates.
If one team participates in events or programs
offered or sanctioned by multiple organizations, ~ · , NCAA-NAIA,
then the rules and regulations of both organizations must be satisfied.
NCAA's own internal governing documents would not ordinarily be a
matter of concern to AIAW.
In this case, however, the NCAA's
entire legal argument with respect to the 14th Amendment and Title IX
is based upon the consequences its legal counsel perceive as stemming from the manner in which NCAA has chosen to draft its own bylaws. This first theory must therefore be kept in mind in consider ing everything which follows.

The theory that the 14th Amendment to the U.S . Constitution

Except for matters of emphasis, AIAW counsel are
essentially in accord ' on the state of the law but differ sharply on
its application to women's intercollegiate athletic programs and
governance. A review of the relevant case law, including the cases
cited in the NCAA legal opinion, fails to disclose any Constitutional
imperative for the NCAA to commence a program for women. We agree
that under prevailing Constitutional decisions women can no longer
be deprived of substantially equal intercollegiate athletic oppor tunities; however , nothing in those prevailing judicial opinions
dictates the manner in which such equality is provided. We believe
that the NCAA's assertion that absorption of the women's program
into the NCAA or any predominantly male organization would not allevi ate but rather institutionalize the deprivation women have experienced
in intercollegiate athletic programs.
For this reason we recommended last October that AIAW enlist the
cooperation of the NCAA in seeking a declaratory judgment regarding
the rights and obligations of the respective organizations and
their member institutions.
It is regrettable that the NCAA not
only subsequently declined to join in a lawsuit for declaratory
judgment, but has now also distributed to all members a legal
opinion that misstates the prevailing legal obligations of that
organization and its member institutions
In our view, the proper
14th Amendment analysis, which is outlined in the following six
paragraphs , supports the proposition that equal opportunity for
women may best be achieved through a separate governing organization.

The 14th Amendment has two basic aspects which relate to in.-t e,rc,allegiate governing organizations:
1.
the due process clause; and
2.
the equal protection clause.
Generally, the due process clause requires that organiza_"t ions ·su.ch
as AIAW an·d NCAA, which act "under color of state law" or' whose

process would require that a sanction be imposed only after there '
has been opportunity on the part of the "accused" to addres_s the

In the present context there is no due process problem. The pivo ~
tal issue, which arises under the equal protection clause, is '
whether men and women collegiate athletes are in fact "similarly
situated," thus raising a requirement that they be treated alike.
In our view they are not. The Schlesinger case, cited abo"v~ , .· i _s
· most closely related to the question of whether a public institu- ,·
tion may "classify" its men's and women's athletic progr.ams dif :..
ferently--~., whether an institution can have i·ts women-'·s· i·ntercollegiate programs competing under the auspices of AIAW ·arid·· its
men's under the auspices of NCAA. In the Schlesinger case, the
United States Supreme Court held that women and men need not be'
subject to the same rules if there is a rational basis for concluding t h at they are not "similarly situated."

It is our opinion, based upon the existing case law, that an institution must provide athletic opportunities for women to the same
extent as it does for men, consistent with the interest, need and
level of competence of each group.
In view of the fact that men
and women in this regard are not "similarly situated" the programs
offered for each need not and probably should not be identical
In those cases dealing with athletics, the courts have emphasized
the existence or nonexistence of comparable opportunities for
women, not identical opportunities; no federal court has required
that unitary teams or athletic administration be adopted.2/ In
Brenden v. Independent School District 742, 477 F.2d 1292-(8th Cir
1973), the only school athletic case to reach any United States
Court of Appeals, the Court specifically noted the absence of
comparable programs for female students in ordering that they be
permitted to participate on male teams. Although no case on point
has yet been decided, there is nothing in existing law to indicate
that a comparable program for women must be administered under the
auspices of the same governing organization as that for men.

The theory that equal opportunity for women can only be provided
through NCAA is invalid.
Implicit and explicit throughout the NCAA
opinion is the assertion that NCAA is so long established and
prestigious that to offer intercollegiate athletic opportunities
for women through AIAW , or any organization other than NCAA, would
be an inherent discrimination against women. This argument derives
from two court decisions concerning a racially and a sexually
segregated college. The case of the University of Texas Law School
(Sweatt v. Painter, 339 US 629 (1950)), was one of a line of
Supreme Court cases dealing with race which foreshadowed the Court's
decision in Brown v. Board of Education, 347 US. 483 (1954),
striking down the "separate but equal" concept with respect to
race. There is no comparable line of cases dealing with sex. The
one case cited by the NCAA relating to sex which was in some measure
based upon the "prestige" of the institution, was a lower court
case dealing with the admissions policies of the University of
Virginia (Kirstein v. Rector and Visitors of Universit of Vir inia,

athletics. Thus there is no judicial indication that comparable
and separate athletic programs for men and women are based upon the
kind of "archaic and overbroad" generalizations that have led
courts to strike down other sex based classifications as intolerable under the Constitution (Schlesinger v . Ballard, supra; Frontiero
v . Richardson, 411 U.S. 677 (1973)). On the contrary, as indicated
above and in the NCAA ' s own memo, the courts which have dealt with
sex discrimination in athletics appear to recognize the validity of
separate but comparable programs in light of the fact that men and
women are not similarly situated with respect to athletics. (See,
~ · · Brenden v. Inde endent School District 742, 477 F.2d 1292
(8th Cir.
; Bue a
Ass'n., 351 F Supp
69 (N . D. Ill . 1972)).
Even assuming, however, on the slender precedent of Kirstein, already
once distinguished in a case affirmed by the Supreme Court, that
the rationale of Sweatt is transferable, a) to women as opposed to
blacks; and b) to athletics as opposed to college admissions, there
remains an insurmountable difficulty with NCAA's reliance upon t hat
rationale as a mandate for its governance of women's collegiate
athletics
The assumption which informs the admissions cases is
that the academic requirements of boys and girls, whites and blacks ,
are identical and that a school which has gained a preeminent
posture with a segregated student body has therefore given to one
class the very thing it has wrongfully withheld from the other.
NCAA itself admits not only that it has never served women but also
that it does not now propose to offer them the same things it
offers men. Thus its arguable preeminence as an intercollegiate
athletic organization for men is wholly irrelevant in the context
of women.3/ As regards women's intercollegiate athletics, in which
NCAA has aone nothing at all, AIAW is by any standard far more ·
experienced and prestigious than NCAA.~/

essentially enunciated in a footnote on page 9 of its legal memo,
which reads in pertinent part as follows:
[I]t should be noted that the Title IX regulations issued
by the Department of Health, Education and Welfare also
purport to have a bearing on the terms of NCAA rules
The regulations are so written as to apply to the athletic
programs of NCAA member institutions, and . . have the
force of law.
Section 86 4l(a) of the HEW regulations
provides in part:
'No person shall, on the basis of sex,
be ... treated differently from another person ... ' With
the exception of rules which provide for separate teams
under the circumstances specified in §86.4l(b), this prohibition plainly bars iny difference in the treatment
accorded male and fema e athletes. Further, §86 6(c)
states that the obligation to comply with the requirements of the regulations 'is not obviated or alleviated
by any rule or regulation of any organization, club,
athletic or other league, or association which would
render any applicant or student ineligible to participate
or limit the eligibility or participation of any applicant or student, on the basis of sex, in any education
program or activity operated by a recipient, and which
receives or benefits from Federal financial assistance.'
Although the legality of these requirements remains to be
determined, it is clear that if valid, they would have
the effect of precluding virtually any difference between
the rules applicable to male and female student-athletes.
While this statement correctly quotes the cited sections of the
Title IX regulations and correctly attributes the force of law
thereto, it does nothing to change the fact that Title IX of the
Education Amendments does not require application of NCAA rules to
·women's athletic programs nor the commencement of a women's program
by NCAA. Title IX prohibits sex discrimination by institutions
receiving federal funds.
In the area of athletics, . the Title IX
regulations promulgated in June 1975 and the explanatory memorandum
issued by HEW clearly state that the regulations do "not address
the administrative structure(s) which are used by educational
institutions for athletic programs. Accordingly, institutions are
not precluded from employing separate administrative structures for
men's and women's sports (if separate teams exist) or a unitary
structure." HEW Memorandum to Chief State School Officers re:

HEW has made clear that 'I'.itle IX requires that equal opportunities
be provided men and women, but it has not dictated the manner in
which such equality of opportunity must be achieved. Speci fica~ly,
the Title IX regulations recognize that separate teams (see §86.41)
and separate athletic administrations (see s orts Guidelines, .supra,
page 3) for intercollegiate athletics may we 1 provide better
opportunity for achievement of comparability for women than. unitary
teams or structures.

An institution provides comparability in levels of competition (one
of the factors required under the Title IX regulations) by offering
intercollegiate programs for men and women. The fact that one is
under the auspices of NCAA and the other under the auspices ·of AIAW
is not significant under Title IX.
Although no case has yet been decided, all indications are that
differing rules and regulations for men and women stemming from
their governance by different intercollegiate governing. organizations would be permissible so long as they were based upon some
legitimate goal and not upon some "archaic and overbroad generalization" about · the sexes. Such legitimate goals could range from
difference in educational philosophy · to availability or level of
competition. The more disparate the rules applied to men and women
on the same campus, the closer the scrutiny that .can be anticipated
from HEW and the courts.
But so long as such rules are fairly
designed to achieve a legitimate, non- discriminatory goal, we would
anticipate their being upheld.
Because Title IX applies directly to member institutions of AIAW
and NCAA and because there is a significant degree of overlap in
the membership of those organizations, cooperative efforts to
identify and coordinate rules and regulations of those organizations would appear advisable.
Such cooperation and coordination
would minimize potential difficulties for member institutions
holding dual membership in AIAW and NCAA.

women within the NCAA then it is inescapable that they are legally
permissible without the NCAA. In fact, it would appear even more
legally sound if such a program and related policies were developed
and applied by an organization with greater expertise in women's
athletics and one in which policy and program were developed primarily by women.
Grave legal questions of de facto and de ju:e discrimination would
be raised if women's intercollegiate athletics were governed by an
organization which by accident or design effectively excluded women
from policy-making capacities. Unless there were basic organizational changes, the NCAA would constitute such an exclusionary
organization.
Summary
It is the opinion of counsel that the NCAA's construction of its
own by-laws as requiring application of its policies to women is
overbroad.
Insofar as it constitutes the premise for its assertion
that there is a legal imperative that NCAA initiate a women's program, it is extremely doubtful that such construction would be legally sustainable. The reference in the NCAA's governing documents
to student-athletes should properly be construed as limited to
those student-athletes participating in NCAA programs.
Further, it is the opinion of counsel that at the present time men
and women student-athletes cannot be said to be "similarly situated"
and therefore neither the 14th Amendment to the U.S. Constitution
nor Title IX of the Education Amendments of 1972 would require an
existing organization serving one sex to institute programs for the
other sex. The institutional requirement of equal athletic opportunity embodied in Title IX (and presumably required under the 14th
Amendment) can be satisfied, and in our view is best satisfied at
this time, by membership in separate governing organizations for
men's and women's athletic programs
Insofar as women's athletics
are concerned, AIAW must be viewed as the most "prestigious" intercollegiate governing organization at this time.
